Terms and Conditions
Effective Date: January 8, 2025
These Terms and Conditions govern the agreement between your photographer and you for photography services. By booking with us, you agree to the following terms:
Services Provided
The Photographer agrees to provide photography services as described in the booking agreement, including but not limited to graduation, special event, car, portrait, pet, and family photos.
- A non-refundable deposit of 50% of the total is required to secure your booking.
- The remaining balance is due 24 hours prior to the photoshoot.
- Payments can be made via CashApp, Venmo, or Apple Pay. Checks are not accepted for amounts under $500.
Cancellation and Rescheduling
- Cancellations must be made in writing. Deposits are non-refundable.
- Rescheduling is allowed based on the Photographer’s availability. An additional fee may apply if changes occur less than 48 hours before the scheduled date.
- Refunds are available if the session is canceled or rescheduled 48 hours prior to the session.
Copyright and Usage Rights
- The Photographer retains copyright ownership of all images.
- The Client is granted a non-exclusive license for personal use of the images.
- Images may not be used for commercial purposes without prior written consent.
- The Photographer reserves the right to use images for portfolio, marketing, and promotional purposes unless the Client requests otherwise in writing.
Image Delivery
- Edited images will be delivered within 14 business days via email or hard drive.
- Large event, superseding $500 may take longer to process (21-30 days).
- Raw or unedited images will not be provided unless explicitly agreed upon in writing.
Liability
- The Photographer will take all reasonable care to capture important moments. However, the Photographer is not liable for circumstances beyond their control, including but not limited to equipment failure, natural disasters, or interference by guests.
- In the unlikely event the Photographer cannot perform services due to illness or unforeseen circumstances, a replacement photographer will be arranged, or a full refund will be issued.
Client Responsibilities
- The Client agrees to provide accurate event details, including location, time, and any specific requests.
- The Client is responsible for obtaining necessary permissions for shooting at specific locations.
Model Release
- By participating in the photoshoot, the Client grants the Photographer permission to use the images for portfolio and marketing purposes unless explicitly stated otherwise in writing.
Force Majeure
- Neither party shall be held liable for delays or cancellations due to events beyond their control, such as natural disasters, government restrictions, or emergencies.
Dispute Resolution
- Any disputes arising from these Terms will first be attempted to resolve through negotiation. If unresolved, disputes will be settled in accordance with the laws of El Paso County.
Agreement
By booking photography services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
